Terms of Service

Overview

This website is operated by Bushwick Kitchen on Shopify. Throughout these Terms, "we," "us," and "our" refer to Bushwick Kitchen. The website, its information, features, tools, products, and services are the Services. By visiting, browsing, purchasing, or otherwise using them, you agree to these Terms and our Privacy Policy. They apply to every user, including browsers, customers, merchants, vendors, and content contributors. If you disagree, do not access or use the Services. New features are also governed by the current Terms.

Section 1 — Access and account

You must be at least the age of majority where you live, and you may allow minor dependents to use a device you own or control only with your consent. To browse or purchase, you may need to provide email, billing, payment, and shipping information; you warrant it is current, complete, accurate, and yours to provide. Keep account credentials secure. You are responsible for account activity and may not sell, assign, license, or transfer the account.

Section 2 — Products

We try to display product colors and images accurately but cannot promise that a particular device will reproduce them correctly. Product appearance or quality may differ from expectations. Descriptions may be changed at any time without notice, and products may be modified, limited by person, region, or jurisdiction, or discontinued. Any offer is void where prohibited; we do not warrant that products, services, information, or corrected errors will meet expectations.

Section 3 — Orders

Submitting an order is an offer to buy, not acceptance by us. Bushwick Kitchen may accept or decline it in its discretion; acceptance occurs only when we confirm it after receiving and processing payment. Review the order first because cancellation may no longer be possible after acceptance. If we reject, change, or cancel, we will try to notify the email, billing address, or telephone supplied. We may limit or cancel quantities per person, household, account, card, address, order, reseller, or distributor. Purchases are for personal or household use, and returns follow the Refund Policy.

Section 4 — Prices and billing

Prices, discounts, and promotions may change without notice. The amount charged is the price effective when the order is placed and shown in its confirmation. Unless stated otherwise, taxes, shipping, handling, customs, and import charges are extra. Online prices may differ from physical or third-party stores. Separate promotion terms prevail if they conflict with these Terms. You must keep purchase, payment, and account information—including email, card number, and expiration—complete, current, and accurate.

Section 5 — Shipping and delivery

Shipping and delivery dates are estimates, not guarantees. We are not liable for delay caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when products are transferred to the carrier. You are responsible for duties, taxes, customs charges, and requirements associated with the destination.

Section 6 — Intellectual property

The Services and their content—including trademarks, brands, text, graphics, photographs, reviews, video, audio, design, layout, and selection—belong to Bushwick Kitchen, its affiliates, or licensors and are protected by intellectual-property law. We grant only a personal, noncommercial right to use the Services. Without prior written consent, you may not copy, reproduce, distribute, modify, display, perform, publish, download, store, transmit, create derivatives, sell, license, or exploit any part. No license to a trademark, patent, copyright, or other right is implied.

Section 7 — Optional tools

We may make third-party tools available without monitoring, control, or input. They are provided "as is" and "as available," without warranties, representations, conditions, or endorsement, and we have no liability arising from their use. Your use is voluntary and at your own risk; understand and accept the provider's terms first. Future tools, resources, or features offered through the Services will also be subject to these Terms.

Section 8 — Third-party links

The Services may contain third-party content or links to websites not affiliated with us. We do not examine or warrant their accuracy, content, practices, products, services, or safety and accept no responsibility for them. Any purchase, use, harm, or damage involving a third party is between you and that provider. Review its policies before transacting and direct complaints or questions to it.

Section 9 — Shopify relationship

Bushwick Kitchen uses Shopify to provide the Services, but purchases are made directly from Bushwick Kitchen. Shopify does not sell the products and is not responsible for transactions, merchandise, injuries, damages, losses, or liabilities involving them. You expressly release Shopify and its affiliates from claims connected with purchases from us.

Section 10 — Privacy

Personal information collected through the Services is governed by our Privacy Policy. Because Shopify hosts the Services, Shopify also collects and processes data about access and use and may transfer it to countries where you do not live. Review both our policy and Shopify's consumer privacy materials.

Section 11 — Feedback

If you submit ideas, reviews, suggestions, proposals, plans, or other feedback, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and commercially exploit it in any medium. We owe no confidentiality, compensation, or response and may monitor, edit, or remove feedback. You warrant it violates no third-party right, is not unlawful, libelous, abusive, obscene, deceptive, or malware-bearing, and does not use a false identity. You alone are responsible for its content and accuracy.

Section 12 — Errors, inaccuracies, and omissions

Information in the Services may contain typographical errors, omissions, or inaccuracies concerning descriptions, prices, promotions, offers, shipping charges, transit times, or availability. We may correct or change such information and cancel affected orders at any time, including after submission, without prior notice. Except as law requires, we have no general obligation to update, amend, or clarify information, and a displayed update date does not mean everything was modified.

Section 13 — Prohibited uses

You may not use the Services for an unlawful, malicious, abusive, deceptive, or infringing purpose; violate any law or our rights; harass, harm, insult, defame, intimidate, or discriminate; submit false information; send spam or malware; collect or track others' personal information; scrape, crawl, phish, pharm, pretext, or interfere with security; use automated systems or artificial intelligence to access, extract, copy, or generate output from the Services; or reproduce, resell, or exploit them. We may suspend or terminate access for a violation.

Section 14 — Agents

If you access the Services for another person through an automated agent, bot, crawler, or similar tool, you represent that you are authorized to bind that person, disclose that you act as an agent, and provide accurate identity and contact information. You may not evade CAPTCHA, rate limits, robots instructions, or access controls, mimic human behavior to conceal automation, or misrepresent purpose. Agent activity remains subject to these Terms and may be blocked or terminated.

Section 15 — Termination

Obligations and liabilities incurred before termination survive it. These Terms continue until ended by you or us. You may terminate by telling us you no longer want the Services or by ceasing use. If we believe you have failed, or suspect you failed, to comply, we may terminate without notice; amounts due through termination remain payable, and access may be denied. Provisions that by nature should survive will remain effective.

Section 16 — Disclaimer of warranties

Information in the Services is provided for general purposes and may not be accurate, complete, or timely; reliance is at your risk. Except where law forbids, the Services and all products are supplied "as is" and "as available," without express or implied representations, warranties, or conditions, including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement. We do not warrant uninterrupted, timely, secure, or error-free use or accurate results, and may remove or suspend the Services without notice.

Section 17 — Limitation of liability

To the fullest extent allowed by law, Bushwick Kitchen, our affiliates, directors, officers, employees, agents, contractors, suppliers, service providers, licensors, and Shopify and its affiliates will not be liable under contract, tort (including negligence), strict liability, or otherwise for direct, indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profit, revenue, savings, data, replacement cost, or similar loss arising from the Services, products, or linked content, even if advised of the possibility. Where exclusions are not allowed, liability is limited to the maximum lawful amount.

Section 18 — Indemnification

You agree to indemnify, defend, and hold harmless Bushwick Kitchen, Shopify, and each of our or their affiliates, partners, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and suppliers from third-party claims, liabilities, damages, losses, and reasonable attorneys' fees arising from your breach of these Terms or incorporated documents, violation of law or another person's rights, or use of the Services. We will give notice unless delay causes no material prejudice, may control defense and settlement, and will not accept a settlement imposing nonmonetary duties on you without consent. You must cooperate.

Section 19 — Severability

If any provision is found unlawful, void, or unenforceable, it will be enforced to the fullest lawful extent and the unenforceable part will be severed. The remaining provisions stay valid and enforceable.

Section 20 — Waiver and entire agreement

A failure to exercise or enforce a right is not a waiver. These Terms, together with posted policies and operating rules, are the entire agreement about the Services and replace all earlier or contemporaneous oral and written communications, proposals, and agreements. Any ambiguity will not be interpreted against a party merely because that party drafted the text.

Section 21 — Assignment

You may not delegate, assign, or transfer these Terms or any right or obligation under them without our prior written consent. An attempted transfer is void. We may assign or transfer our rights and obligations without your consent or notice.

Section 22 — Governing law

These Terms and separate agreements for the Services are governed and construed under the laws applicable where Bushwick Kitchen is headquartered, without regard to conflict-of-law rules. You and Bushwick Kitchen consent to personal jurisdiction and venue in the federal and state or territorial courts serving that jurisdiction.

Section 23 — Headings

Section headings exist only for convenience and do not limit or otherwise affect these Terms.

Section 24 — Changes to these Terms

You can review the current Terms on this page at any time. We may update, replace, or change any part by posting a revision to the website. It is your responsibility to check periodically. Material changes will receive any notice required by law and take effect on the stated date. Continued access or use after posting constitutes acceptance.
